Palaform Ltd is currently operated on a part-time cottage industry basis so please be patient when placing an order or when requesting information about our products. We will endeavour to deal with your order/queries as soon as possible.

Website Terms & Conditions:

By continuing to use our Website you are agreeing to the terms set out below. If you are under 18 years of age, you should ask your guardian to check these terms before preceding any further. These terms and conditions, apply to the usage of the Website and all transactions for the sale of goods on the Website. Please read them carefully. They do not affect your statutory rights. We may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted on the Website.

1. Provision of Website Service

The Website is owned and operated by Palaform Ltd (Company number 3078659), (‘Palaform’) whose registered office is at 22 Nene Close, Wellingborough, NN8 5WB; place of registration – England. We are not V.A.T. registered. All products offered for sale on this website are offered by Palaform Ltd. which will be the contracting party for any order that you place.

2. Limited Rights to Use Content

2.1 All material including any intellectual property in it displayed on the Site (“Content”) belongs to Palaform Ltd. or its suppliers. Subject to section 2.2, we give you the right, for your own personal or non-commercial purposes only to:

Retrieve and display the Content on your PC screen.

Print individual pages on paper.

Store individual pages in electronic form on disk/CD.

You do not have the right to store any Content on any server or other storage device connected to an external network. Or make any other use of the Content.

2.2 Most of the Content is owned by Palaform Ltd. but certain Content is used with the permission of third parties (“Third Party Content”) and may be subject to additional restrictions. These restrictions and/or intellectual property rights will be highlighted through hyperlinks on the appropriate pages. You must comply with such restrictions and/or copyrights.

2.3 You may not, without prior written permission from Palaform Ltd given within the previous 6 months:

Redistribute any of the Content or supply it to other people.

Remove the copyright or trade mark notices from any copies of Content made under this Agreement.

Create a database in any form (including electronic or structured manual form) by downloading, copying and storing all or any of the Content.

Except as expressly set in this Agreement, modify, reproduce or in any way use any of the Content.

3. Participation

3.1 Palaform Ltd allows you to submit material to certain areas of the Website. Palaform Ltd reserves the right to delete, move and edit any material submitted. You are solely responsible for the material you submit to the Website and by submitting any material you agree that you will not submit any material that:

Advertises or promotes any goods or services deemed to be in competition with Palaform Ltd.

Reveals any confidential or sensitive information.

Contains or links to any unlawful, threatening, abusive, libellous, indecent or otherwise illegal material.

Contains any material, which you do not have permission to use (including material which may be protected by copyright, trademarks, database rights or any other form of intellectual property right).

Contains viruses or any other components with harmful or contaminating properties, which may affect the Website, or any equipment connected to it.

Disguises your identity or impersonates any person or entity, including, but not limited to, a Palaform Ltd employee, or falsely claims or otherwise misrepresents your affiliation with a person or entity.

3.2 Palaform Ltd welcomes your comments, suggestions, ideas and other material you provide or send directly to us. By submitting material to the Website, you grant Palaform Ltd a perpetual royalty free, non-exclusive licence to reproduce, modify, translate, make available, distribute and sub-licence any material you submit in whole or in part or in any form. You agree that you waive any moral rights you have in the material.

3.3 The Website contains material and content submitted by persons (“Users”) over whom Palaform Ltd has no control. Palaform Ltd cannot guarantee the accuracy, integrity or quality of any such material. Some Users may breach these terms and post material that is misleading, untrue or offensive – you must bear all risks associated with and resulting from your viewing of such material.

3.4 Copyright of any software that is made available for download for the participation in the Website (“Software”) belongs to Palaform Ltd, its suppliers or Third Parties. Your use of the Software is governed by the terms of any licence agreement that may accompany or be included with the Software. Certain pages on the Website may also be subject to additional terms of use that will be made available clearly by hyperlink – you must comply with all such terms.

4. Online Shopping – Terms and Condition of Sale of goods on www.modelhovercraft.co.uk

4.1 Product Details, Prices and Promotions

We take great care to present the products on our website as accurately as possible.

The prices for goods displayed for sale on the Website are as set out on the Website and are inclusive of VAT. Where additional charges are made for delivery, they are clearly displayed. Prices and delivery charges displayed are valid and effective for the countries and regions we deliver to.

Although we endeavour to ensure that all pricing and delivery information on the Website is accurate, occasionally an error may occur and goods may be miss-priced. If we discover a pricing error we will, at our discretion, either contact you or ask you whether you wish to cancel your order or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.

We reserve the right to adjust prices, offers, products and specifications of products on the Website at our discretion at any time before (but not after) we accept your order. We reserve the right to withdraw any goods from the Website at any time. We will not be liable to you or to anyone else for withdrawing goods from the website. The images you see depend on your monitor’s display and colour capability and may vary as a result. We are therefore unable to guarantee that the pictures of the products you see are an accurate representation of the actual items.

All orders made by you through the Website are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or anyone else in those circumstances. After submitting an order to us we will send you an order acknowledgement email with your order number and details of the goods that you have ordered. Please note that this email is an acknowledgement and is not an acceptance of your order.

Your order represents an offer to us to purchase a product. Palaform Ltd cannot accept your order until you have paid for it in full (including applicable delivery charges). Once you have completed an online purchase, if we are able to accept your order, we will send you an email confirming that the goods ordered have been dispatched to you, unless we have notified you that we do not accept your order or that you have cancelled it in accordance with our returns policy. At this stage payment will be taken and a binding contract between us will exist. In certain circumstances, (section 4.1 and 4.4), it will be possible for either you or us to cancel the order. Please read those sections for more information.

Whilst we are under no obligation to accept your order, we would normally do so where:

The product is available.

The order reflects current pricing.

We receive payment to cover the full amount of the goods and any additional delivery charges

You can access details of your order and any previous orders by logging in to your account once you have registered.

Upon payment, we will confirm acceptance of your order by email, which will be sent to the email address you provide on your order details. Whether or not you receive this email, our acceptance of your order will create a legally binding contract between us. We reserve the right not to supply you at our discretion.

4.2.1 Bulky, Heavy and/or Oversized items

Although a standard delivery charge is indicated in the checkout process, certain items sold on  HYPERLINK “http://www.modelhovercraft.co.uk/” http://www.modelhovercraft.co.uk/ may be subject to an additional delivery charge. This will be due to their weight, bulk and/or size. In this event you will be contacted regarding the total delivery charge and be given the option to amend your order should you wish to do so.

4.2.2 Age restricted items

Where products are deemed unsuitable for use by a certain age group, this will be made clear in the item description. These can include products with small parts which may be unsuitable for children under three years of age. Please be aware that under UK law you must be aged 18 or over to purchase certain products. We age verify all such purchases and may contact you for proof of age. These can include knives, glues and adhesives.

Where Goods may only be purchased by persons of a certain age the Buyer will be asked when placing an order to acknowledge that they have read the Terms and Conditions of the website, and to agree that they are of the appropriate legal age to purchase the Goods. If the Seller discovers that the Buyer is not legally entitled to order certain Goods, the Seller shall be entitled to cancel the order immediately, without notice.

4.2.3 Payments

Payment can be made by Cash on collection, by cheque, by Postal Order, BACS transfer, or by direct payment method using a Paypal account. We currently do not have the facility to accept Credit/Debit card directly from our customers. You may make arrangements to pay Palaform Ltd via Paypal using your credit/debit card using the following e-mail address  HYPERLINK “mailto:” 

Full payment is required prior to any goods being shipped.

4.2.4 Availability

We aim to keep most items in stock to fulfil your orders. However there may be certain situations where items become unavailable. In the unlikely event of this happening we will inform you by email if any items you have ordered are unavailable. We may offer you an alternative item of a similar specification. The new price of the replacement part may vary from the original price. We will notify you of any refunds/additional cost adjustments prior to preparing your order

4.3 Delivery Information

What are your delivery charges or options?

4.3.1 Cost: We try and establish a fair and reasonable charge to cover our costs for postage and packaging. In general, the cost for delivery is established by the weight of the parts and packaging used to protect your order during delivery. Palaform Ltd. reserves the right to alter its delivery charges on any items it sells through its website  HYPERLINK “mailto:”  without giving notice of its intention.

4.3.2 Standard Delivery – Where possible we use Royal Mail first class signed for delivery. This allows us to track your item. Please allow up to five working days for delivery. Prices are as displayed on our website

4.3.3 Deliveries by Courier

For the larger kits we use Couriers to ship the goods. Consignments are delivered anytime between the hours of 9:00am and 6:00pm. Unfortunately it is not possible to specify an am or pm delivery time.

A signature is required when we deliver your order via courier delivery.

If nobody is available to accept the delivery our courier will leave a calling card giving you the opportunity to arrange a more convenient delivery time

Our courier does not deliver on Saturday, Sunday or Bank Holidays.

Please note that we cannot be held responsible for courier delays outside of our control.

4.3.4 Hazardous Materials: New rules from the Post Office that came in to effect on 17/01/2013 prevent us from sending Enamel Paints, Glues, Flammable items and Lithium Batteries via regular post. Instead they will need to be sent via courier. Due to the increased cost of sending these products via courier the charges will be as follows:

Orders under £50 – £3.99

Orders between £50 and £99.99 – £1.99

Orders over £100 – Free

Non UK mainland and Scottish Highland delivery

4.3.5 Europe

Depending on location and local Customs Authorities, European delivery can take up to 14 days after being dispatched and are subject to possible customs clearance and local charges.

All quoted delivery times are based on standard working days i.e. Mon – Fri (excluding public holidays etc.).

Please note bulky items/orders may trigger an additional charge to send it to destinations outside of the mainland UK. In this case you will be contacted to advise you of the all cost options available. 4.3.6 Rest of the World

Costs vary according to the size/weight/value of the product and your location. Before placing your order please contact Palaform Ltd at  HYPERLINK “mailto:” We will advise you of the all cost options available

4.3.7 Delivery Status

If you have not received your order or it is late please contact us. We will try and ensure that the estimated delivery times set out in Section 4.3 are met but we cannot accept any liability for late deliveries, which are due to circumstances outside of our control.

Once you have received the goods, all risk of damage to, or loss of, the goods shall pass to you. If you intend to cancel your order in accordance with the cancellation and returns policy, you must keep good care of the goods pending their return to us.

4.3.8 Undeliverable packages

Occasionally we will have a package returned to us because the couriers were unable to deliver it to you. When this happens we will attempt to contact you to establish if you would like your order re-dispatching or refunding. If we cannot contact you within 2 weeks of receiving your parcel back into our warehouse we will issue a refund for the product. If you choose to request a refund then unfortunately, we can only refund the cost of goods and not the postage, as this is a non-recoverable cost to us.

4.3.9 What if only part of your order has arrived?

Before contacting us please check your paperwork to see whether there is more than one parcel – for example, if it says ‘1 of 2’ or ‘1 of 3’. This means that we were unable to package your entire order on one package and you should expect a further delivery within the next few days. If you order is incomplete then please contact Palaform Ltd at  HYPERLINK “mailto:”  to resolve the issue

4.3.10 What if your order has not arrived at all?

Before contacting us, please check your emails from us or our courier. Please check your junk folder, and ensure that  HYPERLINK “http://www.modelhovercraft.co.uk/” http://www.modelhovercraft.co.uk/ is added to your safe senders list. Then contact us quoting the order number and date of order. We will then track your order with the relevant party and inform you on the delivery status and next steps.

4.3.11 Collecting your order

You are welcome to collect your item from our work shop. As Palaform Ltd is run on a part-time basis, please contact us in first instance to arrange an appointment to visit out premises.

4.4 Online Shopping Cancellation and Returns Policy

Please note that ESC (Electronic Speed controllers) and Electric motors are not covered under the return policy once the wires have been soldered/Cut/Jointed or Damaged in any way.

We believe that you will be delighted with your product but there may be occasions where you feel it necessary to return an item. Our policy is to ensure that you are satisfied every time you purchase an item from  HYPERLINK “http://www.modelhovercraft.co.uk/” http://www.modelhovercraft.co.uk/  If you are unhappy with an item, please return it to us within 14 days of the date on the dispatch note that accompanies your order. Please ensure that you have taken reasonable care of it, the product is in an unused state, it is complete with original packaging and it has all of its original components.

4.4.1 How to return products once received

If you wish return a product you can:

Once you have contacted us, you will be given instructions on how and where to return your purchase. We recommend that you use a secure delivery method, which requires a signature upon receipt (such as via Royal Mail First Class Recorded Delivery) as you will be responsible for the returned products until they reach us.

You must contact us before sending any items back to us.

As the cost of shipping the goods is non-recoverable, we are unable to refund the postage. However if you are not entirely happy with your item, we would be glad to refund the purchase cost. All refunds are processed according to method used to make the original purchase.

4.4.2 Returning faulty products

Returning a faulty item is the same process as 4.4.1, however due to the complexity of certain products, no refunds or exchanges can be given on selected items until a manufacturing defect is identified. This may involve sending it back to the supplier. If spare parts are available, we will also look to repair the existing item before sending a replacement.

If an item is deemed to be faulty; we will refund the cost of both the outgoing and incoming mail.

If a manufacturing fault has not been determined, we will either:

Return the item to you.

Repair the item to a working condition and invoice you for the parts and labour used.

We will always contact you before carrying out either of the above actions.

5. Limited Warranties

Palaform Ltd will use its reasonable skill and care in making sure that the Site is available to you on a continual basis. However, because of the number of sources from which Palaform Ltd obtains the Content and because of the nature of the Internet, Palaform Ltd does not give you any other warranties. In particular, you should not take the accuracy or availability of the information for granted and Palaform Ltd makes no warranty that the Site is free from infection by viruses or anything else that has contaminating or destructive properties. Palaform Ltd (The Seller) warrants that the Goods will at the time of dispatch correspond to the description given by the Seller.

6. Limitation of Liability

6.1 In respect of the Content that is available on the Site, Palaform Ltd will use its reasonable endeavours to resolve faults. You agree that Palaform Ltd will not be liable for any losses (other than damages for death or personal injury resulting from Palaform Ltd’s negligence) you may incur as a result of your use or non-use of that Content.

6.2 Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the Price of the Goods and the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.

6.3 Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury resulting from the negligence of the Seller or that of the Seller’s agents or employees.

7. Subscribing to our mailing list to receive our email newsletter

Our site’s registration form requires users to give us their contact information (e.g. name and email address) in addition to some demographic information (e.g. postcode). If you request to receive information from Palaform Ltd, we will use customer contact information from the registration form to send you electronic newsletters or similar types of information.

9. General

9.1 There is no specific time limit applying to your access and use of the site. However, Palaform Ltd. reserves the right to suspend or terminate your access and use at any time. It may exercise this right with or without notice.

9.2 You may not assign, sub-licence or otherwise transfer this Agreement or your rights of access to the Site.

9.3 Failure by either party to exercise any right or remedy under this Agreement does not constitute a waiver of that right or remedy.

9.4 A person who is not party to this Agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its terms.

9.5 English law will apply to this Agreement and both you and Palaform Ltd agree to submit to the non-exclusive jurisdiction of the English Courts. We are required by law to inform you that sales can be concluded in English only.

9.6 Waiver: No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.

Appendix

If you are a new customer you can choose to register or to proceed to the checkout immediately without registering. If you register, this will save you time entering your name, address and delivery details the next time you order. We do not store any debit/credit card details on our system

To register with us please complete all the required Personal and Contact information, then choose and confirm a password. The password should be no more than 8 characters long and can be alphanumeric. We will send all correspondence regarding your order to the email address you enter in this form so please be sure to enter accurate contact information. We will only use this email address to communicate with you regarding your order, unless you have subscribed to receive our email newsletter. Any information is stored in compliance with Data Protection Legislation and we enforce strict internal security procedures to ensure compliance and prevent unauthorised access.

If you are an existing customer, to sign in simply click on the ‘Login’ button and enter the email address you registered with and your password.

How to place an order

When you have found an item you wish to purchase, select your required quantity, then click on ‘Add to Cart’ and the item will be placed in your shopping cart.

Click on ‘Continue Shopping’ to return to your previous page. You can then continue shopping until you have selected all the products you require. At any time you can check what you have chosen by clicking on ‘Shopping Cart’ where you can review and amend the quantities you have selected.

Once you have completed your selection, click on ‘Check out’. Here you will see the following options, these are:-

Option a) Pickup from Store (as our business is run on a part-time basis, please e-mail us to arrange an appointment),

Option b) UK shipping (By weight), here you will be notified the cost for delivery charges.

Step 5: Payment Method: Two option available, please select the option that you require.

Option a) Cheque/ Money Order Instructions,

Option b) Paypal (a much quicker service)

(Please note that if the option (a) is selected then the order will not be sent out until full payment has been received)

Place a check on “I have read and agree to the Terms and Conditions” to complete your order to proceed to the next page to Confirm your Order.

Note: For Delivery costs for outside of UK Mainland, This will depend on what items are required, please contact Palaform Ltd through  HYPERLINK “mailto:”  We will advise you with the best option for delivery.

Your order has now been placed. We will provide you with an order reference number, together with all the details you have already confirmed. Please print this order summary, and retain it as your reference. Your order will also be acknowledged by an email. When your order has been successfully dispatched, we will acknowledge this with another email
